We reserve the right to modify, reject or cancel your booking whenever it becomes necessary. If we cancel your order and have already processed your payment, we will give you a refund equal to the amount you paid. You agree that it is your responsibility to monitor your payment instrument to verify receipt of any refund.

Booking & Portal Access Terms and Conditions

Introduction
The terms and conditions outlined in this online booking agreement, along with the details provided in the appointment form (referred to as the “Registration Form”) and the Website Terms of Use, are collectively referred to as the “Terms.” These collectively constitute a legally binding agreement between you and Sana Health Ltd. t/a Sana Health Diagnostic (“Sana Health Diagnostic”, “we”, or “us”).

Agreement Between Us
The contractual relationship between you and us, as outlined in these Terms, shall come into effect upon your completion and submission of the Registration Form, subsequent processing, and acceptance of your request by Sana Health Diagnostic, accompanied by the receipt of payment for the Service. Upon acceptance of your appointment application, Sana Health Diagnostic will confirm via email.

Should you choose to arrange an appointment via this platform, you may be required to provide specific details (via the Registration Form Page or other means). Our Privacy Policy outlines how any personal information you provide to us will be used. By providing such information, you affirm that it is accurate, complete, and current. By scheduling any appointment, you agree to settle all charges at the prevailing rates when the appointment is booked.

Sana Health Diagnostic reserves the right to decline any appointment request for any reason. Appointments may be deferred or revoked if accurate information is not provided and/or if Sana Health Diagnostic is unable to establish contact with the appointment holder or the primary cardholder.

Payment Procedure
Prices are liable to alteration without prior notification.
We strive to present precise pricing, product and service descriptions, information, images, and availability as of the moment the data is submitted for display on the Site. Nevertheless, we retain the authority to rectify inaccuracies, including but not limited to prices and promotions, that have been publicized on the Site.

Access To The Portal
Registered users will receive a designated username and password for accessing the Site. Your username and password are solely for accessing the subscribed results permitted for you on the Site. You are accountable for all activity conducted under your Site account, including safeguarding your username and password. Sharing your username and/or password with any third party for accessing the Site is prohibited.

Your Responsibilities:

When using the Services, you agree to:

Provide accurate and complete information about yourself and/or your organization as needed by Sana Health Diagnostic (referred to as “Patient Registration Data”).
Inform Sana Health Diagnostic promptly about any changes to the Patient Registration Data to ensure it remains accurate and complete.
Refrain from providing false, inaccurate, outdated, or incomplete information. Sana Health Diagnostic may suspend or terminate your account if you do so.
Use the Site for lawful purposes only and refrain from engaging in any unlawful activities.
Ensure that your communications to the Site are lawful, truthful, and accurate.
Understand that you are solely responsible for any content you submit to the Site, including its legality, reliability, and appropriateness.
Avoid posting any unlawful, threatening, defamatory, or obscene material on the Site.

Data Processing

Sana Health Diagnostic provides services (“Services”) for patients of the Portal (“Registered Patients” or “You”). The results of these services (“Results”) are accessed by Registered Patients through the Portal (“Site”). Both Sana Health Diagnostic and the Registered Patients collect, store, and process Personal Data of the Registered Patients. This Personal Data, whether on paper or in digital form, is protected by laws like the Data Protection Acts 1988 and 2003 (“Acts”). These laws set rules on how Personal Data can be handled, and breaking them can lead to legal consequences and damage to reputations. Sana Health Diagnostic and Registered Patients both respect the privacy rights of patients and have created this schedule to ensure they follow the Acts properly.

Limitation of Liability
Sana Health Ltd. t/a Sana Health Diagnostic and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities and expenses including legal fees from your use of the Site.

Indemnity
Except where prohibited by law, by using this Site you indemnify and hold harmless Sana Health Ltd. t/a Sana Health Diagnostic and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of our Site or your violation of these Terms and Conditions.

Applicable Law
These Terms and Conditions are governed by the laws of Ireland.

Dispute Resolution
Subject to any exceptions specified in these Terms and Conditions, if you and Sana Health Ltd. t/a Sana Health Diagnostic are unable to resolve any dispute through informal discussion, then you and Sana Health Ltd. t/a Sana Health Diagnostic agree to submit the issue first before a non-binding mediator and to an arbitrator in the event that mediation fails. The decision of the arbitrator will be final and binding. Any mediator or arbitrator must be a neutral party acceptable to both you and Sana Health Ltd. t/a Sana Health Diagnostic.

Notwithstanding any other provision in these Terms and Conditions, you and Sana Health Ltd. t/a Sana Health Diagnostic agree that you both retain the right to bring an action in small claims court and to bring an action for injunctive relief or intellectual property infringement.

Severability.
If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.

Changes
We reserve the right, in our sole discretion, to change, modify, add or remove portions of these Terms at any time without notice and without liability. You should check these Terms periodically for changes as by using the Site after we post any changes to these Terms, you are agreeing to accept those changes, whether or not you have reviewed them.
